Accommodations Review Process

Applicants are encouraged to submit their accommodations documentation well before the submission deadline. The accommodations submission process takes time: the Office of Attorney Admissions (“OAA”) will need time to review the initial submission, and applicants may need to provide additional information. Late submissions will NOT be considered for any reason, and requests for extensions that are not based on emergent or unforeseen disabilities will likely not be granted.

ALL DOCUMENTATION MUST BE SUBMITTED BY THE SUBMISSION DEADLINE. THE OAA WILL NOT REVIEW DOCUMENTATION SUBMITTED AFTER THE SUBMISSION DEADLINE, INCLUDING DOCUMENTATION ATTEMPTING TO CURE A NOTICE OF INCOMPLETE. The only exception to this policy is documentation related to a timely appeal of a Notice of Determination.

The OAA will make every effort to review accommodations documentation submission within 14 days of the applicant’s complete submission.

If the initial submission is deemed incomplete or insufficient, the OAA will provide a Notice of Incomplete to the applicant via email. The applicant must comply with the Notice of Incomplete by the deadline specified in the letter.

  • If the applicant timely cures the Notice of Incomplete, the OAA will conduct its review of new documentation promptly on receipt.
    • If the cured submission is complete and sufficient, the OAA will provide a Notice of Determination via email. Applicant has 14 days from the date of the Determination to appeal.
    • If the cured submission remains incomplete or the applicant does not timely comply with the Notice of Incomplete, the OAA will issue a Notice of Standard Testing at the expiration of the compliance period listed in the Notice of Incomplete. No appeal is allowed from any portion of a Notice of Incomplete that has not been cured.
  • If the initial submission is deemed complete and sufficient, the OAA will provide a Notice of Determination to the applicant via email. The applicant has 14 days from the date of the Notice of Determination to appeal. The appeal process is the only time when the OAA will consider documentation filed after the submission deadline.
  • If the applicant appeals the Notice of Determination, the OAA will review the appeal documentation promptly on receipt and provide a Notice of Appeal Determination. If the exam is scheduled to commence within 28 days of the Notice of Appeal Determination, the Notice of Appeal Determination is final as to that scheduled exam, and no further appeals are allowed as to that scheduled exam.
  • If the applicant does not appeal the Notice of Determination, the OAA will send an Individualized Examination Schedule to the applicant before the exam.

Examples:

  1. Applicant A submits their bar or LLP exam application and accommodations documentation when the application registration period opens. Within its 14-day review period, the OAA determines that the accommodations submission is incomplete and issues a Notice of Incomplete. The Notice gives Applicant A a deadline by which they must cure the deficiencies in their submision. Applicant A timely cures their submission. The OAA determines that the modified submission is complete and issues a Notice of Determination to Applicant A. By submitting their accommodations documentation early in the process, Applicant A left enough time to cure the Notice and will test with the accommodations granted.
  2. Applicant B submits their bar or LLP exam application when the application registration period opens but waits until the accommodations submission deadlineto submit their accommodations documentation. The OAA determines that the accommodations submission is incomplete. Because the accommodations submission deadline has passed, Applicant B has no opportunity to cure the deficiencies in their submission. The OAA will not review any documentation submitted after the deadline, even if the documentation is intended to cure a deficient submission. Applicant B will test under standard conditions.
  3. Applicant C timely submits their bar or LLP exam application but submits their accommodations documentation seven days before the submission deadline. After the submission deadline has passed, but within its 14-day review period, the OAA determines that the submission is complete and issues a Notice of Determination. Applicant C notifies the OAA of their intent to appeal their determinatino. ONLY in this circumstance may Applicant C supplement their submission with new appeal documentation.
