Preliminary Questionnaire Instructions

Foreign-educated and Non-ABA Accredited Law School Graduates must provide required information for an eligibility determination to sit for the Colorado Bar Exam. This Prequalification Determination Questionnaire is NOT an application to sit for the Colorado Bar Exam. It is an eligibility determination only; you will be directed to the appropriate Colorado Bar Exam Application if the Office determines you meet the eligibility requirements to sit for the exam.
Eligibility determination requests and Bar Exam Application deadlines apply at all times and cannot be waived. If you may need an eligibility requirement waiver from the Colorado Supreme Court, you must plan accordingly so that you can meet ALL relevant deadlines.
Please note that eligibility is for the upcoming exam administration only and not for future administrations of the exam. Informal eligibility determination requests sent via email, mail, phone, or in-person will not be accepted. This online questionnaire is the only official method by which you may receive an eligibility determination to sit for the Colorado Bar Exam.
If you obtained your original law degree (J.D., LLB or equivalent) from a foreign law school (this is not regarding an LLM you may have earned in the United States), read the General Information for Graduates of Foreign Law Schools before proceeding. By proceeding with the Prequalification Determination Application, you must be prepared to submit the required documentation in order for your eligibility to sit for the upcoming bar exam administration.
If you obtained your original law degree (J.D.) from a U.S. law school not accredited by the Council of the Section of the Legal Education and Admissions to the Bar of the American Bar Association (ABA) but accredited by a U.S. jurisdiction or recognized U.S. accreditation entity, read the General Information for Graduates of Non-ABA Accredited Law Schools before proceeding. By proceeding with the Prequalification Determination Application, you must be prepared to submit the required documentation in order for your eligibility to sit for the upcoming bar exam administration.
If you are admitted to practice law in a foreign jurisdiction or in another U.S. jurisdiction, you must provide a current Certificate of Good Standing for each jurisdiction in which you are admitted regardless if you are on an Active or Inactive license. If you are unable to obtain a current Certificate of Good Standing from a foreign jurisdiction due to civil unrest, active war zone, or other disruption of judicial administrative services, you will need to provide and upload a written explanation in the Prequalification Determination Application in the section where a Certificate of Good Standing is required. A waiver of this requirement granted by the Colorado Supreme Court may be required under C.R.C.P. 206. If the Office determines a waiver is required, the Office will advise you of that need, if necessary, when evaluating your eligibility application.
Complete and file electronically the Prequalification Determination Questionnaire Application after reviewing C.R.C.P. 204.3 and the relevant General Instructions applicable to your situation.

The applicant:

has completed a course of study at a foreign law school that is accredited in the jurisdiction where it is located, and the course of study is based on the principles of English common law and substantially equivalent in duration to a J.D. legal education program provided by an ABA-accredited or state-accredited U.S. law school;
is authorized to practice law in a foreign jurisdiction or another U.S. jurisdiction and is in good standing in all jurisdictions where admitted or authorized to practice; and
has been actively and substantially engaged in the lawful practice of law for at least three of the last five years as defined by C.R.C.P. 203.2 immediately preceding the applicant's most recent application.

A J.D. degree or an equivalent professional law degree completed at a foreign law school that is earned primarily through online courses or other distance-learning programs that do not meet the distance learning requirements of the ABA Standards for Approval of Law Schools does not satisfy the requirements of this rule.

has completed a course of study at a foreign law school that is accredited in the jurisdiction where it is located, and the course of study is based on the principles of English common law and substantially equivalent in duration to a J.D. legal education program provided by an ABA-accredited U.S. law school; and
has completed an LL.M. degree that meets the curricular requirements of this rule at an ABA-accredited U.S. law school.

has completed a course of study at a foreign law school that is accredited in the jurisdiction where it is located, and the course of study is not based on the principles of English common law, but is substantially equivalent in duration to a J.D. legal education program provided by an ABA-accredited U.S. law school; and
is authorized to practice law in a foreign jurisdiction or in another U.S. jurisdiction and is in good standing in all jurisdictions where admitted or authorized to practice; and
completed an LLM degree that meets the curricular requirements of this rule at an ABA-accredited U.S. law school.

Applicants applying pursuant to C.R.C.P. 203.4(3)(b)(U.S. state-accredited law school graduate) AND C.R.C.P. 203.4(4)(a)(Path A foreign law school) (foreign-educated, common-law country graduates who do not have a qualifying LLM from an ABA-accredited law school) must show they have been engaged in the authorized, active practice of law for at least three years of the preceding five years (36 months in the preceding 60 months) from the date of submitting an exam application.

Provide on the resume the duration (month, day and year of commencement and termination) of each period of such employment, the organization or entity with whom or which you were so employed, and a brief description of your legal responsibilities in the employment.

If the physical location of your practice is not within a jurisdiction where you are licensed, please be prepared to provide legal justification that demonstrates your practice was permitted in the jurisdiction where you are licensed as well as the jurisdiction where your practice occurred.

Child Support

Are you currently or ever been subject to an order to pay child support? Child support order means any administrative or court order requiring the payment of child support, child support arrears, child support debt, retroactive support, or medical support, whether or not such order is combined with an order for maintenance.

C.R.C.P. 208.2(1)(c) requires that all Applicants must provide evidence and certify that they are in compliance or have complied with any child support orders. Note that if you are in arrears for child support and are not current on any court or agency ordered repayment plan, you are ineligible for admission to practice law in Colorado until you can certify and provide evidence that you are in compliance.

Attorney Disbarment or Resignation in Lieu of Discipline

Are you disbarred from the practice of law or resigned a law license pending disciplinary proceedings in another U.S. jurisdiction?

C.R.C.P. 203.1(6) provides that a person who has been disbarred from the practice of law in another jurisdiction, or who has resigned pending disciplinary proceedings in another jurisdiction, other than a reciprocal action based upon a Colorado disbarment, is not eligible to apply for admission to the practice of law in Colorado until the person has been readmitted in the jurisdiction in which the person was disbarred or resigned in lieu of discipline.

Attorney Discipline Suspension

Are you suspended for disciplinary purposes from the practice of law in another U.S. jurisdiction?

C.R.C.P. 203.1(7) provides that a person who has been suspended for disciplinary purposes from the practice of law in another jurisdiction, other than reciprocal discipline based upon Colorado discipline, is not eligible to apply for admission to the practice of law in Colorado until the period of suspension has expired and the person has been reinstated to the practice of law in the jurisdiction in which the person was suspended.
